Copyright Policy

1. Our position

Nupcii respects the intellectual property rights of others and expects its users to do the same. Some of the content that appears on invitations created with Nupcii (photos, text, audio) is uploaded by users themselves, who declare that they hold the necessary rights when uploading it, as set out in our Terms and Conditions.

We respond to notifications of claimed copyright infringement under the United States Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512). This page describes how to submit a notification, what we do when we receive one, and how the affected user may respond.

2. Designated agent

Notifications of claimed copyright infringement should be sent to our designated agent, registered in the U.S. Copyright Office's DMCA Designated Agent Directory:

3. How to submit an infringement notification

To be valid under the DMCA (17 U.S.C. § 512(c)(3)), a notification must be a written communication addressed to our designated agent that includes substantially the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
  2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works on the same site are covered, a representative list of such works).
  3. Identification of the material claimed to be infringing and information reasonably sufficient to permit us to locate it (for example, the exact URL of the invitation or page within nupcii.com).
  4. Contact information for the complaining party: address, telephone number and, if available, an email address.
  5. A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

If a notification does not substantially meet these requirements, we may contact the complaining party so it can be completed before we process it. Before sending a notification, please consider whether the use of the material may qualify as fair use.

4. What we do when we receive a notification

  • We acknowledge receipt of the notification.
  • If the notification is valid, we expeditiously remove or disable access to the identified material.
  • We promptly notify the user who uploaded the material, informing them of the removal and of their right to submit a counter-notification.
  • We record the infringement on the user's account for the purposes of our repeat infringer policy (section 6).

5. Counter-notifications

If you are a Nupcii user and believe your material was removed as a result of mistake or misidentification, you may send a counter-notification to our designated agent pursuant to 17 U.S.C. § 512(g)(3). It must be a written communication that includes:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location at which the material appeared before it was removed.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located if your address is in the United States or, if your address is outside of the United States, for any judicial district in which Nupcii may be found, and that you will accept service of process from the person who provided the original notification or an agent of such person.

Upon receiving a valid counter-notification, we will promptly provide a copy to the person who submitted the original notification. Unless that person informs us within 10 business days that they have filed a court action to restrain the claimed activity, we will restore the material between 10 and 14 business days after receiving the counter-notification.

Please note that sending a counter-notification has legal consequences: it includes statements under penalty of perjury and consent to the jurisdiction of United States courts. If in doubt, consult a lawyer before sending one.

6. Repeat infringer policy

Nupcii will, in appropriate circumstances, terminate the accounts of users who repeatedly infringe copyright. We treat as a confirmed infringement any valid notification that is not answered with a successful counter-notification. Repeat infringement may result in the loss of content upload features or the termination of the account, without any right to a refund.

7. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents information in a notification or counter-notification may be liable for damages (including costs and attorneys' fees) incurred by the affected user, the copyright owner, or Nupcii. Do not submit notifications about content that does not infringe your rights, or counter-notifications about material you know to be infringing.

8. Claims from outside the United States

If you are a rights holder outside the United States (for example, in Colombia, Mexico, or Spain), you may use this same channel: write to [email protected] identifying the work, the URL of the material, and your contact details, and we will diligently process your claim under the applicable rules.
